Terms & Conditions
Last updated: October 9, 2026
Please read the Dispute Resolution section carefully. It requires individual arbitration and waives class actions.
Agreement
These Terms & Conditions (the "Terms") are an agreement between you and Club House Brand ("Club House Brand", "we", "us" or "our"). They apply to clubhousebrand.com (the "Site"), our online store, our events, the ClubHouse Sessions podcast and our other content (together, the "Services"). By using the Services, you accept these Terms. If you do not agree, do not use the Services.
Eligibility
You must be at least 18, or the age of majority where you live, to use the Services or make a purchase. Minors may attend our events only with a parent or guardian who accepts these Terms on their behalf.
Changes to these Terms
We may update these Terms. We will change the "Last updated" date and, for material changes, post a notice on the Site. Using the Services after a change means you accept the updated Terms.
Privacy
Our Privacy Policy explains how we handle personal information and forms part of these Terms.
Purchases
- Where you buy. Products are sold on our online store at shop.clubhousebrand.com. The store's checkout terms and payment provider also apply to your order.
- Prices and availability. Prices, products and availability may change without notice. We may limit quantities, refuse or cancel an order (for example, if a product was listed at the wrong price), and we will refund any payment for an order we cancel.
- Shipping and returns. [TBC: CLIENT TO CONFIRM SHIPPING, RETURNS AND EXCHANGE POLICY].
- Resale. Products are sold for personal use. Buying for commercial resale requires our written permission.
Events and tickets
- Ticketing. Tickets and RSVPs are sold or handled through Eventbrite or another third-party platform, whose terms also apply.
- Refunds. Tickets are non-refundable except where the law requires or where we cancel the event. If we cancel, we will refund the ticket price you paid. If we reschedule, your ticket carries over to the new date, or you may request a refund within the period we announce.
- Changes. Line-ups, featured players, talent, schedules and activities may change without notice. A change to the line-up is not grounds for a refund.
- Weather. Golf events may be delayed, shortened or rescheduled for weather or course conditions. These changes are not grounds for a refund unless the event is cancelled entirely.
- Conduct. Follow venue rules, course etiquette and staff instructions. We may refuse entry to, or remove, anyone who is unsafe, disruptive or breaks the rules, without a refund.
- Alcohol. Alcohol is served only to guests 21 and over with valid ID. Please drink responsibly.
- Assumption of risk. Golf and related activities carry inherent risks, including being struck by balls or clubs, golf cart incidents, heat and uneven ground. You take part voluntarily and accept those risks. We may ask you to sign a separate waiver at events.
- Photos and recordings. By attending, you agree that we may photograph, film and record you at the event and use that content in our podcast, social media and promotion, without payment.
- Ticket resale. Tickets may not be resold above face value or used for promotions without our written permission.
Sponsorships and partnerships
Sponsorship packages are confirmed only by a written agreement or invoice from us. That agreement governs deliverables, payment and cancellation, and it prevails over these Terms if the two conflict. Package details and prices shown anywhere are not an offer until we confirm them in writing.
Our content
The Site, the ClubHouse Sessions podcast, music, videos, photos, logos and other content are owned by or licensed to Club House Brand. You may view, stream and share our content for personal, non-commercial use with the share tools we provide. You may not copy, re-upload, edit, sell or use it commercially without our written permission. "ClubHouse", "ClubHouse Brand Supply", "ClubHouse Sessions" and related logos are our trademarks.
Acceptable use
You agree not to: break the law; scrape, copy or harvest data from the Site; interfere with the Site's security or operation; upload viruses or harmful code; impersonate anyone; post anything unlawful, hateful or infringing; or use the Services to send spam.
Your submissions
If you send us content, ideas or feedback, you grant us a non-exclusive, royalty-free, worldwide license to use, edit and share it in connection with the Services, and you confirm you have the right to grant this license.
Third-party services
The Services link to and rely on third parties, including our store platform, Eventbrite, Instagram, YouTube, venues and sponsors. We are not responsible for their content, products or practices.
Disclaimer of warranties
The Services are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee the Site will be uninterrupted or error-free.
Limitation of liability
To the fullest extent the law allows, Club House Brand and its owners, team, partners and sponsors are not liable for indirect, incidental, special, consequential or punitive damages, or lost profits, arising from the Services or our events. Our total liability for any claim is limited to the greater of the amount you paid us for the product, ticket or service in question, or US $100. Nothing in these Terms limits liability that cannot be limited by law.
Indemnification
You agree to defend and indemnify Club House Brand against claims, losses and costs, including reasonable legal fees, arising from your breach of these Terms, your conduct at our events, or your misuse of the Services.
Dispute resolution
- Talk to us first. Email hello@clubhousebrand.com and we will try to resolve the issue informally within 30 days.
- Arbitration. If we cannot, the dispute will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in Broward County, Florida, or remotely. Either party may instead bring a qualifying claim in small claims court.
- No class actions. Claims may be brought only individually, not as a plaintiff or class member in any class or representative proceeding. You and we both waive any right to a jury trial.
- Opting out. You may opt out of arbitration by emailing us within 30 days of first accepting these Terms.
Governing law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Subject to the Dispute Resolution section, the state and federal courts in Broward County, Florida have exclusive jurisdiction.
Events beyond our control
We are not responsible for any failure or delay caused by events beyond our reasonable control, including weather, natural disasters, public health orders, venue closures, power or internet outages, or government action.
General
These Terms, together with the Privacy Policy and any event or sponsorship agreement, are the entire agreement between you and us. If any part is found unenforceable, the rest still applies. Our failure to enforce a term is not a waiver of it. You may not transfer your rights under these Terms; we may transfer ours to a successor. We may send notices to you electronically.
